District & Circuit Court Documents

It's all about paperwork and the Courts love paperwork. No matter what Family Law matter you are undertaking it will require forms / paperwork to be filled in and filed in the Court. We offer a simple solution, just give us the basic details and we will send you the the paperwork ready to print with full instructions.   • Is it difficult to get a Divorce or Judicial Separation in Ireland?
    Yes & No. If you and your ex spouse are in agreement about everything then yes it is relatively straightforward. If you don't agree then it can take time but if you follow the processes and rules of the Court then it will be much easier.
  • If we are still living together can we still get divorced?
    Yes. If you are living separately under the same roof you can get Divorced. Either before or once a Divorce is granted that situation will change and one person will have to leave the home unless it is being sold.
  • How long do we have to be living apart to get divorced?
    You must be living apart for at least two out of the last three years to qualify for a divorce. If you are living separately in the same home this counts as time apart. Judicial Separations has a different set of criteria, these can all be explained in a consultation.
  • How long does a consultation take?
    Every case is different but you should allow a minimum of at least one hour for your consultation.
  • Why are the District & Circuit Courts different?
    The District Court deals with Family Law matters for people who are not married or are still married but living separately i.e. Guardianship, Access, Custody, Maintenance. It also deals with Domestic Abuse applications such as Protection, Safety or Barring Orders. The Circuit Court is a higher Court and deals with Judicial Separation and Divorce for married couples and protections for Co-Habiting couples. The High Court deals with certain specific Family Law matters.
  • What is the difference between Guardianship, Custody and Access?
    This is a great question, Guardianship means the rights and duties of parents in respect of the upbringing of their children. Custody refers to the day-to-day care, residency and upbringing of children who are regarded as dependent. Access refers to the right of a child to maintain direct contact with the parent with whom the child does not reside. Visit our Blog here for mor information.   • How do I get a Maintenance Order from the Court?
    If you are not married or are still married but living separately you need to go to your local District Court Office to make an application for maintenance. The District Court is limited to the amount of maintenance that can be ordered i.e. maximum €150 per child per week and €500 spousal maintenance per week. If you are seeking more than these amounts then your application needs to be made in the higher Circuit Court.
