District Court Declaration of Service
When serving District Court documents in Family Law matters you are required to provide proof of serving those documents to the other person. This can be done either by way of Registered Post or Personal Service (handing it to the person). Proof that you served the documents is made by way of a Declaration of Service that needs to be signed and witnessed by a Solicitor, Commissioner of Oaths or a Peace Commissioner. If someone else personally serves the document on your behalf they need to make the Declaration of Service.
You will need to email a clear picture or scan of both the Certificate of Post and the document you served to support@familylawcentre.ie
IMPORTANT NOTE
If your are serving your document by Registered Post you MUST get a Certificate of Post as well as the printed post receipt with the tracking number. THIS IS A COURT REQUIREMENT.
If your are serving your document by personal service, you should try and have a video recording of you, or a person you authorise, handing the document to the other person. While not a mandatory requirement it is recommended in case the other person disputes you serving the document on them.
